| 7. | APPLICATION FOR VARIANCE RE: MALCOLM HAMILTON – 425 NEREPIS ROAD (A) DEVELOPMENT OFFICER’S REPORT DATED JUNE 10, 2009 Applicant, Malcolm Hamilton was present and advised the Committee of the following; * this Application for Variance is for half the total square area for an accessory building than his previous Application; * he will be using the garage mainly to do general maintenance to his tractor trailer cab and also to store same during the winter months. Present speaking in favor of this Application were: * Matthew & Robyne Foster – 421 Nerepis Road There was no one present speaking against this Application. The Committee then stated to Mr. Hamilton that this indeed the largest Variance they have considered approving and had concerns as to should he ever sell the property in the future, that this would encourage a potential buyer to establish an automotive repair business. Therefore, it was recommended that in order to protect his neighbours from this being a possibility, that a condition be considered to prohibit this from happening. Mr. Hamilton concurred and the following motion was made: “…moved by Chyann Kirby that the Planning Advisory Committee approve the Request for Variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 101, to increase the maximum area of an accessory building, located at 425 Nerepis Road, PID No. 458687 (the property) pursuant to Section 5.1.2, and grant a Variance of 40 m² to increase the maximum area for an accessory building from 75 m² to 115 m², Subject to the condition that the Owner of the subject property enter into an agreement with the Town, binding upon the Owner, his heirs and assigns, and registered on the title, to the effect that the garage building to be constructed on the subject property shall be used for storage only and not be used for business, commercial or industrial purposes.…” Motion seconded by Jim Burke. Carried. |
