RE: MARIA ROOKARD - 4 HALL ROAD (A) DEVELOPMENT OFFICERS REPORT DATED JUNE 11, 2008 (B) LETTER RECEIVED FROM GLEN & ELOUISE CAULFIELD DATED JUNE 12, 2008 Owner, Wayne Comeau was present and addressed the Committee as follows: * His proposal is to construct a new type of fencing around the pool that mounts along the outside of the pool and has a lockable gate/stair; * due to budget reasons, he plans on putting a deck around the pool next year; * he does not like the look of the chain link fence and feels it would be easier for a child to climb it; * in his opinion, this type of fencing is superior to a chain link fence which will exceed the by-law requirement for height by 1 and 1/2 feet; * he has polled his neighbours with no objection; * his first priority is safety, as he has a 5 year old grandson who resides with him; * this fencing will only be temporary and will be replaced next year with decking around the pool; * he has checked with surrounding Municipalities and has learned that they allow this type of system, therefore feels it should be adequate for the Town of Grand-Bay-Westfield. The Committee then expressed to Mr. Comeau their concerns as follows: * The Towns By-law does not permit this type of fencing because the system does not meet the 1.25 m required separation between the water and the enclosure; * safety is by far the biggest concern and Committee members would not feel comfortable approving this type of fencing; * statistics show that 50% of children who drown in Canada do so in back yard pools. Letter received from Mr. and Mrs. Caulfield states they have no objection to this proposal. There was no one else present speaking in favor of or against this Application. moved by Jim Burke that the Planning Advisory Committee to DENY the request for variances to the Towns Zoning By-law, Town of Grand Bay-Westfield By-law No. 101, regarding the location and placement of a pool enclosure, to be located at 4 Hall Road, PID No. 00120709 . RE: ARTHUR & SANDRA BOUDREAU 24 WOOLASTOOK DR. (A) DEVELOPMENT OFFICERS REPORT DATED JUNE 12, 2008 Applicants, Arthur & Sandra Boudreau were present. Mr. Boudreau addressed the Committee as follows: * The property was purchased two years ago and they are now in the process of building a single family dwelling; * his original plans have been revised due to the slope of the land at the back of the property exposed during excavation has required Fundy Engineering to revise their design of the site for the placement of footings on undisturbed soil; * he is requesting Variances to move the footings an additional 2 ft. forward and for the reduction in the overall height of the foundation above the centre line grade of the street by 2 ft.; * this reduction in elevation will not look out of place with other existing properties which are mostly all below grade, but will still provide positive slope of the grade away for the house. There was no one else present speaking in favor of or against this Application. moved by Linda Estabrooks that the Planning Advisory Committee to APPROVE the following Variances to the Towns Zoning By-law, Town of Grand Bay-Westfield By-law No. 101, for the construction of a single family Dwelling, to be located at 24 Woolastook Drive, PID Nos. 00217166, 30069108: a) under Section 8.2.2.3(d), grant a variance of 0.61 m to further reduce the required Front Yard Setback from 4.57 m to 3.96 m; b) under Section 8.1.7, grant a variance of 500 mm to reduce the required elevation above the centre line grade of the street (at the centre of the house) from 750 mm to 250 mm .
