1. CALL TO ORDER
The Town of Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Monday, September 19, 2005 at 8:03 p.m. with Chairman, Larry Chapman presiding.

All Members were present with the exception of James Evans, who was excused with cause. 
 
3.  PLANNING ADVISORY COMMITTEE MINUTES OF SEPTEMBER 6, 2005
“…moved by Mel Steffens to accept as presented the September 6, 2005 Planning Advisory Committee Minutes….”

Seconded by Cllr. Little.  Carried.
 
4.  REGULAR COUNCIL MINUTES OF AUGUST 8, 2005 
“…moved by Ralph Stevens to receive and file the Regular Council Minutes of  August 8, 2005 ….”

Seconded by Jim Burke.  Carried. 
 
5.  CHAIRMAN’S REMARKS
 The Chairman requested the following Item be added to the Agenda.

“…moved by Cllr. Little that a letter received from Peter A. Perry dated September 19, 2005 be added to the Agenda as Item No. 8(b)….”

Seconded by Ron Daigle.  Carried.

7.  TOWN MANAGER’S MEMO DATED SEPTEMBER 12, 2005
RE: 2006 BUDGET REQUEST

“…moved by Ralph Stevens to Table the Town Manager’s Memo dated September 12, 2005 Re: 2006 Budget Request to the October 3, 2005 meeting, for more budget detail….”

Seconded by Jim Burke.  Carried. 
 
8. APPLICATION FOR VARIANCE
RE: GRANT MAXWELL – 37 MAJESTIC DRIVE
(A) DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 15, 2005
(B) PETER A. PERRY LETTER DATED SEPTEMBER 19, 2005

Applicant, Grant Maxwell was present and gave the following presentation:

  • Mr. Maxwell had a display of pictures available of the property in question;
  • he advised that the concrete slab for the pergola has been in place for the past 5 years, with no objection from his neighbours;
  • the fence in question has been in place for little over a year; 
  • he was not aware at the time the fence was erected that a permit was required;
  • conditions exist which make it impossible to reverse what has been done without substantial cost and hardship.
There was no one else present speaking in favor of this Application.

Peter Perry of 38 Sunset Crescent was present speaking against this Application, as per his letter dated September 19, 2005, as follows:

  • the existing fence has been erected without a permit and is not located in accordance with the Town’s Zoning By-law;
  • the fence in question is on his property and should be dismantled;
  • if the variance is granted, this could pose a safety issue as it presently obstructs his vision when exiting his driveway.
The Chairman advised that the Application before PAC this evening is for Variances to locate a fence and structure within front yard setbacks. 

 “ …moved by Mel Steffens that the Planning Advisory Committee, regarding the following request for Variances to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 101, for the construction of an accessory structure, and fence to be located at 37 Majestic Drive, PID No. 30076293:

a) under Section 5.1.4, grant a Variance of 6.28 m to reduce the required Front Yard setback from 7.5 m to 1.22  m for the construction of the pergola;
b) under Section 5.9.4, deny a Variance to reduce the required street line setback from 1.5 m for a fence….”

Seconded by Ralph Stevens.  Carried.
