RE: PAC TERM EXPIRATIONS moved by Linda Estabrooks that the Planning Advisory Committee advise Council that two of the Committees 3-year terms are due to expire on January 1, 2010; and that both Members, Ralph Stevens and Jim Evans, have re-offered for appointment to new terms from January 2, 2010 to January 1, 2013 . Seconded by Jim Burke. Carried. |

APPLICATION FOR VARIANCE
RE: JAMES ANDREW SHAW 4 ALLAN STREET (A) DEVELOPMENT OFFICERS REPORT DATED OCTOBER 28, 2009 Applicant, Andrew Shaw was present and addressed the Committee regarding his Application for Variance for the construction of a new dwelling, requiring a Variance to build below street grade. Mr. Shaw submitted to the Committee for their perusal, a topographical sketch and house design he proposes to build, and advised the following: * He has slightly modified his original plan, thereby eliminating the need for a culvert and plans to continue on with the natural swale that is already there; * he is confident that the swale between the two properties is sufficient to control any water problems, as he has not experienced any water problems in the past on Woolastook Drive; * his reasons for wanting to build below grade is so that he will be more in line with his existing house; there is a driveway already in place and he does not want to obstruct the river view of his neighour across the street; * the property already has a sanitary manhole and is on a municipal easement and without a Variance, a lift station would have to be installed, making it too expensive; * he plans on having a walk out basement at the back. The Committee stated to Mr. Shaw that his Proposal does not reflect exactly what he is planning nor does it address their concerns with regard to the slope of the driveway, water drainage, proper frontage and grade. It was also stated to him that the Committee wishes to assist him in any way possible, however to do so, a more detailed presentation is required. Mr. Shaw advised that he will gladly have a Site Plan done up, as a Variance is required before he goes ahead and sub-divides the land. There was no one present speaking in favor of or against this Application. moved by James Evans that the Planning Advisory Committee Table this Application for Variance until such time the Applicant submits additional information . RE: ALDORIA SAULNIER 4 BRANDY CRESCENT (A) DEVELOPMENT OFFICERS REPORT DATED NOVEMBER 2, 2009 There was no one present speaking in favor of or against this Application. moved by Linda Estabrooks that the Planning Advisory Committee recommend to Council to accept $621.03, as money in lieu of Land for Public Purposes requirements (cash, money order, certified cheque or debit) for the purpose of creating one new building lot on Inglewood Drive, out of PID No. 00224055, as shown on the Tentative Subdivision Plan, Aldoria & Linda Saulnier Subdivision, Lot 09-01 and Lot 09-02, as prepared by DeSaulniers Surveys Inc. and dated October 28, 2009; with approval of final Subdivision Plan to be subject to: a) payment of $621.03 (cash, money order, certified cheque or debit); b) any additional utility easements as required by NB Power & NB Tel for servicing the lot to be recorded and signed on the Final Plan; c) recording of Civic Number 205 for Lot 09-01 on the Final Subdivision Plan d) and approval of the Works Commissioner for placement of new driveway culverts ..
